This Waiver, Release and Indemnity Agreement (this “Agreement”) is entered into as of the date written below by and between the undersigned (the “Participant” or “I”) and the Releasees (as defined below). In consideration of being permitted to use the Facilities and participate in the Activities (as such terms are defined below), the Participant hereby agrees as follows:

1. DEFINITIONS. In this Agreement, (a) “Activities” means all activities, events, functions and services provided, arranged, organized, sponsored or authorized by any of the Releasees, including,, without limitations: bocce ball activities, escape room activities; axe throwing activities, including but not limited to coaching sessions, tournaments and events, league and non-league play and the use of all related equipment; and the use of the Facilities generally and all other related activities; and (b) “Facilities” means the premises located at 383 King Street West, Toronto, Ontario, both indoors and outdoors, or such other facilities at which the Activities may be offered from time to time by the Releasees.
2. VOLUNTARY PARTICIPATION. I acknowledge that I am (a) 18 years of age or older; and (b) using the Facilities, participating in and/or supervising the Activities and executing this Agreement voluntarily and of my own accord.
3. ASSUMPTION OF RISKS. I acknowledge that there are inherent risks associated with the use of the Facilities and participation in the Activities, including, without limitation, exposure to moving or dangerous objects, use of mechanical and electrical devices and access to confined and dimly lit spaces. I accept such risks voluntarily and assume responsibility for any consequences, including, but not limited to, property damage, illness, injury and/or death, arising out of or related to my use of the Facilities and/or participation in the Activities. I further acknowledge that the Activities may not be supervised or monitored by staff at all times. With respect to any outdoor Activities, I agree to ensure that gameplay remains entirely within the allotted area(s) and that I will not interfere with the public or cause damage to public or third-party property.
4. RULES, POLICIES AND VIDEO MONITORING. I will abide by all rules and policies in place at the Facilities, and will discontinue participating in the Activities if I observe any unusual hazard or if at any time I feel unfit to safely continue for any reason. I acknowledge that closed circuit cameras have been installed in the Facilities for security purposes and I consent to being monitored and recorded for such purposes. I further grant permission to the Releasees to take photographic or video representations of me during my participation in the Activities and to publish same for advertising, promotional and marketing purposes. I waive any and all claims against the Releasees arising out of such use, including claims relating to defamation or invasion of any copyright, privacy, personality or publicity rights.
5. WAIVER AND INDEMNITY. I hereby expressly waive any claims, complaints, actions, causes of action, liabilities, costs (including legal costs) or demands (collectively, “Claims”) that I may now or hereafter have against EMT Limited Partnership, any of its affiliates, partners, and limited partners, and/or any of their respective owners, directors, officers, employees, shareholders, representatives, contractors, subcontractors, agents, assigns or successors, past, present and future (collectively, the “Releasees”) to which I or any of my heirs, executors, administrators, assigns or beneficiaries (collectively, the “Releasors”) may become entitled to for any and all property damage, illness, injury and/or death, no matter how it may be caused, including negligence, breach of contract, statutory duty or any other implied duty of care, relating in any way whatsoever to my use of the Facilities and/or participation in the Activities. I further to agree to indemnify and hold harmless the Releasees in respect of any third-party Claims associated with my participation (or the participation of those under my supervision) in the Activities.
6. COVID-19. The coronavirus known as COVID-19 has been declared a worldwide pandemic and is extremely contagious. EM is taking all possible precautions to control the spread of COVID-19 and is following local, provincial and federal regulations and guidelines pertaining to its operation. However, EM cannot guarantee that the Participant will not become infected with COVID-19 despite the preventative measures EM is taking. Accordingly, by signing this Waiver the Participant further:
   1. acknowledges the highly contagious nature of COVID-19 and voluntarily assumes the risk of becoming exposed to or infected with COVID-19 as a result of participating in the Activities;
   2. confirms that neither the Participant nor anyone residing with the Participant has experienced or exhibited cold or flu-like symptoms in the past 14 days (including fever, sore throat, cough, respiratory difficulty, or other similar symptoms); and
   3. confirms neither the Participant nor anyone residing with the Participant has travelled outside of Canada within the past 14 days.

I ACKNOWLEDGE HAVING READ, UNDERSTOOD AND AGREED TO THE TERMS OF THIS WAIVER, AND UNDERSTAND THAT BY SIGNING THIS DOCUMENT I AM WAIVING CERTAIN LEGAL RIGHTS THAT I MAY HAVE AGAINST THE RELEASEES AND THAT THIS WAIVER SHALL CONSTITUTE A RELEASE OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW.

This Waiver, Release and Indemnity (this “Waiver”) is entered into as of the date written below by and between the undersigned participant (“I” or the “Participant”) and Escape Artistry Pty Ltd, operating as Escape Manor Brisbane (“EM”). In consideration of being permitted to use EM’s facilities located at 51 Edward Street, Brisbane, QLD (the “Facilities”) and participate in the escape room activities offered by EM (the “Activities”), the Participant hereby agrees as follows:

1. Voluntary Participation. I acknowledge that I am: (a) 16 years of age or older; and (b) using the Facilities, participating in the Activities and executing this Waiver voluntarily and of my own accord.
2. Assumption of Risks. I acknowledge that there are inherent risks associated with the use of the Facilities and participation in the Activities, including, without limitation, exposure to moving objects, use of mechanical and electrical devices and access to confined and dimly lit spaces. I accept such risks voluntarily and assume responsibility for any consequences, including, but not limited to, property damage, illness, injury and/or death, arising out of or related to my use in any way of the Facilities and/or participation in the Activities. I will abide by all rules and policies in place at EM, and will discontinue participating in the Activities if I observe any unusual hazard or if at any time I feel unfit to safely continue for any reason.
3. Rules, Policies and Video Monitoring. I acknowledge that closed circuit cameras have been installed in the Facilities for security purposes and I consent to being monitored and recorded for such purposes. I further consent to my photograph or likeness being used by EM to evidence my successful escape of an escape room during the Activities.
4. Waiver. I hereby expressly waive any claims, complaints, actions, causes of action, liabilities, costs (including legal costs) or demands (collectively, “Claims”) that I may now or hereafter have against EM or any of its directors, officers, employees, shareholders, contractors, agents, affiliates, assigns or successors, past, present and future (collectively, the “Releasees”) to which I or any of my heirs, executors, administrators, assigns or beneficiaries (collectively, the “Releasors”) may become entitled to for any and all property damage, illness, injury and/or death, no matter how it may be caused relating in any way whatsoever to my use of the Facilities and/or participation in the Activities.
5. Indemnification. I will indemnify and hold harmless the Releasees of and from any and all Claims arising from my use of the Facilities and/or participation in the Activities.
6. Destruction of Property. I agree to act in a controlled and reasonable manner while participating in the Activities and agree to fully reimburse EM for any loss or damage to property caused by my negligent or reckless behaviour.
7. Governing Law. This Waiver shall be governed by the laws of the state of Queensland and the federal laws of Australia applicable therein. I hereby attorn to the exclusive jurisdiction of the courts of the State of Queensland.

I ACKNOWLEDGE HAVING READ, UNDERSTOOD AND AGREED TO THE TERMS OF THIS WAIVER, AND UNDERSTAND THAT BY SIGNING THIS DOCUMENT I AM WAIVING CERTAIN LEGAL RIGHTS THAT I MAY HAVE AGAINST THE RELEASEES AND THAT THIS WAIVER SHALL CONSTITUTE A RELEASE OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW.

I further acknowledge that the Activities may not be supervised or monitored by staff at all times.

RULES, POLICIES AND VIDEO MONITORING. I will abide by all rules and policies in place at the Facilities, and will discontinue participating in the Activities if I observe any unusual hazard or if at any time I feel unfit to safely continue for any reason. Furthermore, I acknowledge that if any employee of the Releasees believes that I am intoxicated or that it is unsafe for me to continue to participate in the Activities for any reason, I may be prohibited from engaging or continuing in same. I acknowledge that closed circuit cameras have been installed in the Facilities for security purposes and I consent to being monitored and recorded for such purposes. I further grant permission to the Releasees to take photographic or video representations of me during my participation in the Activities and to publish same for advertising, promotional and marketing purposes. I waive any and all claims against the Releasees arising out of such use, including claims relating to defamation or invasion of any copyright, privacy, personality or publicity rights.

WAIVER. I hereby expressly waive any claims, complaints, actions, causes of action, liabilities, costs (including legal costs) or demands (collectively, “Claims”) that I may now or hereafter have against EMT Limited Partnership, any of its affiliates, partners, and limited partners, and/or any of their respective owners, directors, officers, employees, shareholders, representatives, contractors, subcontractors, agents, assigns or successors, past, present and future (collectively, the “Releasees”) to which I or any of my heirs, executors, administrators, assigns or beneficiaries (collectively, the “Releasors”) may become entitled to for any and all property damage, illness, injury and/or death, no matter how it may be caused, including negligence, breach of contract, statutory duty or any other implied duty of care, relating in any way whatsoever to my use of the Facilities and/or participation in the Activities.
6. COVID-19. The coronavirus known as COVID-19 has been declared a worldwide pandemic and is extremely contagious. EM is taking all possible precautions to control the spread of COVID-19 and is following local, provincial and federal regulations and guidelines pertaining to its operation. However, EM cannot guarantee that the Participant will not become infected with COVID-19 despite the preventative measures EM is taking. Accordingly, by signing this Waiver the Participant further:

I ACKNOWLEDGE HAVING READ, UNDERSTOOD AND AGREED TO THE TERMS OF THIS WAIVER, AND UNDERSTAND THAT BY SIGNING THIS DOCUMENT I AM WAIVING CERTAIN LEGAL RIGHTS THAT I MAY HAVE AGAINST THE RELEASEES AND THAT THIS WAIVER SHALL CONSTITUTE A RELEASE OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW. I ALSO AGREE THAT BY EXECUTING THIS WAIVER, I REPRESENT THAT I AM NOT UNDER THE INFLUENCE OF ANY ILLICIT DRUGS AND HAVE NOT AND WILL NOT CONSUME LEGAL SUBSTANCES OR PRESCRIPTION DRUGS TO THE EXTENT THAT MY MOTOR SKILLS, JUDGMENT OR ABILITY TO THINK CLEARLY BECOME IMPAIRED.

This Waiver, Release and Indemnity (this “Waiver”) is entered into as of the date written below by and between each of the undersigned participant(s) (“I” or the “Participant”) and 101300246 Saskatchewan Ltd. o/a Escape Manor Regina (“EMR”).

In consideration of being permitted to use the facilities at 1975 Broad Street, Regina (the “Facilities”) and participate in the escape room activities offered by EMR (the “Activities”), the Participant hereby agrees as follows:

1. Voluntary Participation. I acknowledge that I am: (a) 16 years of age or older and/or am accompanied by a person that has reached the age of majority in Saskatchewan; and (b) using the Facilities, participating in the Activities and executing this Waiver voluntarily and of my own accord.
2. Assumption of Risks. I understand that there are inherent risks associated with the use of the Facilities and participation in the Activities, including, without limitation, exposure to moving objects, use of mechanical and electrical devices and access to confined and dimly lit spaces. I voluntarily accept such risks and assume responsibility for any consequences, including, but not limited to, property damage, illness, injury and/or death, arising out of or related to my use of the Facilities and participation in the Activities.
3. Destruction of Property. I agree to act in a controlled and reasonable manner while participating in the Activities and agree to fully reimburse EMR for any loss or damage to the Facilities or property therein caused by my actions.
4. Marketing and Promotional Activities. I acknowledge that EM may publish or otherwise use (a) images or video of my participation in the Activities and use of the Facilities, and (b) feedback provided by me in verbal or written form regarding my experience at EM, for general marketing and promotional purposes. I hereby consent to the use of such images and feedback for the above-noted purpose in accordance with applicable privacy laws and understand that such content will be removed or deleted by EM to the greatest extent possible upon my written request.
5. Rules, Policies and Video Monitoring. I will abide by all rules and policies of EMR and will discontinue participating in the Activities if I observe any unusual hazard or if at any time I feel unfit to safely continue for any reason. I acknowledge that cameras have been installed in the Facilities for security purposes and I consent to being monitored and recorded for such purposes.
6. Waiver. I hereby expressly waive any claims, complaints, actions, causes of action, liabilities, costs (including legal costs) or demands (collectively, “Claims”) that I may now or hereafter have against EMR or any of its directors, officers, employees, shareholders, contractors, agents, affiliates, assigns or successors, past, present and future (collectively, the “Releasees”) to which I or any of my heirs, executors, administrators, assigns or beneficiaries (collectively, the “Releasors”) may become entitled to for any and all property damage, illness, injury and/or death, however caused and relating in any way whatsoever to my use of the Facilities and/or participation in the Activities.
7. Indemnification. I will indemnify and hold harmless the Releasees of and from any and all Claims arising from my use of the Facilities and/or participation in the Activities.

   2. confirms that neither the Participant nor anyone residing with the Participant has experienced or exhibited cold or flu-like symptoms in the past 14 days (including fever, sore throat, cough, respiratory difficulty, or other similar symptoms); and
   3. confirms neither the Participant nor anyone residing with the Participant has travelled outside of Canada within the past 14 days.
8. Destruction of Property. I agree to act in a controlled and reasonable manner while participating in the Activities and agree to fully reimburse EM and/or the Diefenbunker museum for any loss or damage to property caused by my negligent or reckless behaviour.
9. Governing Law. This Waiver shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein. I hereby attorn to the exclusive jurisdiction of the courts of the Province of Ontario.
